1. Introduction & Definitions
1.1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the J-Exchange website (j-exchange.co.za) and your physical transactions with us. By booking a collection, delivering goods to our hub, or accessing our digital platform, you agree to be bound by these Terms.
Warning: If you do not agree to these terms, you must not use our services.
1.2. Interpretation and Definitions
- "The Company" refers to Jyaras Jewellers (Pty) Ltd t/a J-Exchange.
- "The Website" refers to

- "The User" refers to any individual, corporate entity, or automated system accessing the website.
- "Content" refers to all text, pricing algorithms, code, and logos, which remain the sole intellectual property of the Company.
1.3. Governing Law
These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the High Court of South Africa (Gauteng Local Division) for any disputes.
1.4. Changes to Terms
The Company reserves the right to modify these terms at any time without prior notice. Continued use of the website or services after any changes constitutes your acceptance of the new Terms.
2. Website Use & Intellectual Property
2.1. License and Prohibited Acts
The Company grants the User a limited, revocable license to access the Website for personal or business commerce.
- No Scraping: You may not use data mining, robots, or screen scrapers to extract content or pricing.
- No Reverse Engineering: You may not attempt to decipher or decompile any software used to provide the Website.
2.2. "As Is" Disclaimer
The Website is provided "as is" without warranties. We are not liable for any loss resulting from technical downtime or pricing display errors.
3. For Sellers & Recyclers (The "Trading Floor" Rules)
Applicable to anyone selling scrap metal, e-waste, or IT assets to J-Exchange.
3.1. Warranty of Ownership (Stolen Goods Policy)
By presenting goods for sale to the Company, you warrant that:
- You are the lawful owner of the goods or have written authorization from the owner to sell them.
- The goods are not stolen or encumbered by any lien.
⚠️ Suspicious Transactions (SAPS Mandate)
In terms of Section 4 of the Second-Hand Goods Act we are mandated to report any attempt to sell goods suspected of being stolen. We reserve the right to detain goods and impede the seller's departure until SAPS attendance, should reasonable suspicion exist.
3.2. Grading & Pricing
- Indicative Pricing: Prices displayed on our website or quoted via WhatsApp are estimates only.
- Final Grading: The final purchase price is determined solely by J-Exchange staff upon physical inspection at our facility. Our grading decision is final.
4. For Corporate Clients (The "Service Level" Rules)
4.1. Data Liability & Indemnity
While the Company adheres to strictly audited NIST 800-88 sanitization protocols, we accept no liability for any civil damages, loss of profits, or business interruption resulting from the loss or destruction of data. It is the client's sole responsibility to back up critical data before handover.
4.2. Chain of Custody
Transfer of liability occurs only when the Electronic Collection Note (e-Waybill) is signed by both the J-Exchange driver and the Client representative. Until this signature is applied, the assets remain the responsibility of the client.
5. For Buyers (Refurbished Goods)
5.1. CPA Warranty (Section 56)
In accordance with the Consumer Protection Act (CPA), refurbished goods sold by the Company carry a 6-month implied warranty of quality.
Exclusions: This warranty expressly excludes defects arising from normal wear and tear consistent with the age of second-hand assets, battery degradation, or software incompatibility issues not present at the time of sale.
5.2. Cooling Off Period (Online Only)
In terms of Section 44 of the ECTA, consumers purchasing goods online have a 7-day cooling-off period to return goods for a full refund.
Exception: This DOES NOT apply to goods that have been customized or upgraded to your specific order specifications (e.g., RAM/SSD upgrades performed on request).
6. Corporate Value Recovery (Rebates)
6.1. Anti-Bribery & Payment Destination
Rebates and buy-back payments will ONLY be paid into the bank account of the juristic entity (Company) that owns the assets. Under no circumstances will the Company facilitate cash payments or transfers to personal bank accounts of staff or IT managers. This ensures compliance with the Prevention and Combating of Corrupt Activities Act.
6.2. Self-Invoicing
The Client agrees that the Company will generate the Tax Invoice on behalf of the Client for the sale of the assets (Self-Invoicing) to streamline administration.
